These terms are an agreement between you and Hayden Kong (“we”, “us”), the developer of FuelSA. By downloading or using FuelSA you agree to them. If you do not agree, please do not use the app.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use FuelSA on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, redistribute or resell the app, except where that restriction is prohibited by law.
2. Fuel prices are indicative, not a quote
This is the most important term in this document.
Fuel prices shown in FuelSA are sourced from the South Australian Fuel Pricing Information Scheme, which publishes prices reported by fuel retailers. We do not set, verify or control those prices. Prices change frequently and reporting can be delayed, incomplete or incorrect.
A price shown in FuelSA is not an offer, a quote, or a guarantee that the price is available. Always check the price displayed at the station before you fill up. Trading hours, station locations, fuel availability and contact details may also be out of date.
3. Use the app safely
Do not use FuelSA while driving. Check prices and plan your stop before you set off, or while safely parked. You are responsible for complying with road rules in your state or territory.
4. Third-party data and trademarks
Fuel price and station data is supplied through the South Australian Fuel Pricing Information Scheme and remains subject to any terms published by the Government of South Australia. Maps and optional station contact details come from Apple Maps.
FuelSA is an independent app. It is not affiliated with, endorsed by, sponsored by or connected to the Government of South Australia, the SA Fuel Pricing Information Scheme, Apple Inc., or any fuel retailer or service station brand.
Brand names and logos shown in FuelSA are used solely to identify the station brand reported by the scheme. All trademarks, trade names and logos remain the property of their respective owners. If you own a brand shown in FuelSA and want its artwork changed or removed, email fuelsa@haydenkong.com and we will action it promptly.
5. Availability
FuelSA depends on a data service we do not operate. We do not promise the app will be available, uninterrupted or error-free, and we may change, suspend or discontinue any part of it. Where the underlying data service is unavailable, FuelSA cannot show current prices.
6. Your Australian Consumer Law rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right or remedy you have under law that cannot lawfully be excluded.
7. Limitation of liability
Subject to clause 6, and to the maximum extent permitted by law:
- FuelSA is provided “as is” and “as available”, without warranties of any kind, including as to accuracy, completeness, currency or fitness for a particular purpose;
- we are not liable for any loss or damage arising from your reliance on prices, trading hours, locations or other information shown in the app, including wasted travel or a difference between a displayed price and the price charged;
- we are not liable for any indirect, incidental, special or consequential loss; and
- where liability cannot be excluded, our total liability is limited to resupplying the app or paying the cost of resupply, which for a free app is nil.
8. Apple
These terms are between you and us, not with Apple. Apple has no obligation to provide maintenance or support for FuelSA. If FuelSA fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to FuelSA. Apple is not responsible for addressing any claim by you or a third party relating to FuelSA, including product liability, regulatory non-compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9. Changes to these terms
We may update these terms. The current version is always published on this page with its “last updated” date. Continuing to use FuelSA after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
